Terms of Service

The HSE Hub is an online platform operated by The HSE Hub LLC serving the industrial, renewable energy, oil & gas, and construction sectors. The platform currently provides the following services: • A job board and candidate marketplace connecting verified employers with workers • Confidence Reports, a paid human-reviewed candidate vetting and HSE advisory service • A paid library of Toolbox Talk safety training materials available for one-time purchase • Professional consulting packages including incident investigation, safety audits, and virtual safety management • A verified Provider Directory listing training providers, equipment suppliers, safety consultancies, and staffing firms, with optional paid Sponsored Placement • PPE Inspection Guide, an educational resource on protective equipment hazards, inspection checks and removal-from-service criteria • Field Safety Insights articles and a free Safety Checklist for general educational use • Boneyard Reports, a community equipment-failure and hazard reporting feed • Skill Assessments, Project Pipeline intelligence, Safety Alerts, and industry news • Worker support tools including Career Pathways, the Gear Advisor, and Safety Reminders • Career Services, paid resume preparation and interview coaching packages for candidates, plus a free monthly newsletter • Safety Procurement, a free bulk pricing request service that passes equipment and PPE enquiries to third-party suppliers and partners The HSE Hub does not employ workers, place candidates, act as a staffing agency, sell or supply safety equipment directly, or provide accredited training. We provide technology, information, and advisory services only. All employment relationships are formed directly between employers and candidates, and all purchases of equipment or training are transacted directly between users and third-party providers.

Confidence Reports (vetting reports) produced by The HSE Hub represent the professional advisory opinion of our certified HSE reviewers based on information available at the time of review. These reports: • Are advisory documents only and do not constitute a guarantee, warranty, or representation of any kind regarding candidate fitness, safety record, or performance • Are based in part on candidate-provided information, which The HSE Hub has not independently verified in all cases • Should be used as one input among many in a hiring process, not as the sole basis for any hiring decision • Do not create any employment or contractual relationship between The HSE Hub and the candidate or employer Skill Assessment scores displayed on candidate profiles are self-administered knowledge checks and carry the same advisory status. They are not a certification, license, or measure of on-the-job competence.

Employers using The HSE Hub agree that: • They are solely responsible for all hiring decisions, including background checks, reference checks, skills verification, and suitability assessments • They will conduct their own due diligence in addition to any information provided by The HSE Hub • They will comply with all applicable employment laws, equal opportunity regulations, and workplace safety requirements • Job postings must be accurate, lawful, and describe genuine open positions; The HSE Hub may remove postings that are misleading, duplicated, or unrelated to the industries we serve • Employer accounts are subject to a verification review before gaining access to candidate profiles and vetting services • Reviews submitted about candidates must be truthful and based on direct working experience • They will not use The HSE Hub platform or candidate data for any unlawful discriminatory purpose • The HSE Hub bears no liability for any hiring decision, employment outcome, workplace incident, or damages arising from their use of the platform

Candidate accounts on The HSE Hub are free. Candidates using The HSE Hub agree that: • They are solely responsible for the accuracy, completeness, and truthfulness of all information provided in their profile, including certifications, work history, and credentials • Providing false, misleading, or inaccurate information is grounds for immediate account termination • They will promptly update their profile to reflect changes in certification status, employment, or availability • Skill Assessments must be completed by the candidate personally without outside assistance • They understand that their profile may be viewed by verified employers on the platform and that contact details will be shared with employers who pay the Confidence Report fee or to whom they submit a job application

Training providers, equipment suppliers, safety consultancies, staffing firms, and other companies ("Providers") that list on The HSE Hub agree that: • Listing submissions are subject to a verification review. The HSE Hub may request accreditation evidence, business documentation, or other supporting materials, and may approve, reject, or remove a listing at its sole discretion • Providers are solely responsible for the accuracy of all company information, service descriptions, certifications granted, service areas, pricing displays, and accreditation evidence they submit • Providers must hold and maintain any licenses, accreditations, or certifications they claim, and must promptly update or remove claims that are no longer valid • A verified listing is provided free of charge. Sponsored Placement is an optional paid subscription that grants priority positioning in the directory, expanded promotional gallery slots, and sponsor attribution on selected Toolbox Talk categories • Sponsored Placement does not constitute an endorsement, recommendation, or guarantee of quality by The HSE Hub. Sponsored listings are labeled as such • The HSE Hub does not participate in, guarantee, or take responsibility for any transaction, training outcome, or service agreement between a Provider and a user • The PPE Inspection Guide is an educational resource, not a product recommendation, inspection certification, or substitute for manufacturer instructions and site-specific training

All payments on The HSE Hub are processed by Stripe, Inc. in accordance with Stripe's terms of service and privacy policy. The HSE Hub does not store payment card details. Prices are stated in US dollars and may change with notice on our Pricing page. Confidence Report Fee ($299 per report): This one-time fee covers the human review and preparation of a professional vetting report. Confidence Report fees are non-refundable once the report has been delivered to the requesting employer. If a report cannot be completed (for example, the candidate has deleted their account), a full refund will be issued. Employer Plan (monthly subscription): Billed monthly at the rate shown on the Pricing page. May be cancelled at any time. No partial refunds are issued for unused portions of a billing period. Cancellation takes effect at the end of the current billing cycle. Provider Sponsored Placement ($199 per month): Billed monthly. May be cancelled at any time, after which the listing reverts to a free verified listing at the end of the current billing cycle. No partial refunds are issued for unused portions of a billing period. Toolbox Talk Downloads ($4.99 per talk): One-time purchase granting a personal, non-transferable license to download and use the selected Toolbox Talk for internal safety briefings. Purchases are non-refundable once the download has been made available. Consulting Services: Incident Investigation ($1,500), Safety Audit ($2,500), and Virtual Safety Manager ($2,500 per month) purchases are fully non-refundable. Each engagement is limited to the scope described on the Services page and any written intake, proposal, or statement of work accepted for that engagement. Work outside the agreed scope may require a separate agreement and additional fees. The HSE Hub may schedule, sequence, or decline requested work when necessary for safety, legal, capacity, or conflict reasons. Career Services: Resume Rebuild ($149), Interview Prep Session ($99), Job Ready Package ($199), and Resume Update ($39) are one-time purchases. Career Services purchases are non-refundable once work has begun. Deliverables are limited to the service description shown on the Career Services page. The HSE Hub does not guarantee job placement, interviews, offers, or any other employment outcome. Candidate accounts, profiles, job applications, Skill Assessments, Project Pipeline access, Safety Procurement bulk pricing requests, and the monthly newsletter are free of charge.

Users may submit content to The HSE Hub, including candidate profiles and resumes, job postings, Boneyard Reports (equipment-failure and hazard reports, including photos), candidate reviews, and Provider listings ("User Content"). • You retain ownership of your User Content. By submitting it, you grant The HSE Hub LLC a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and process that content for the purpose of operating, improving, and promoting the platform • You represent that you have the right to submit the content and that it is accurate, lawful, and does not infringe the rights of any third party • Boneyard Reports are submitted for community safety awareness. Published reports are reviewed before appearing in the public feed, but The HSE Hub does not independently verify the facts of any report and does not make findings about any manufacturer or product • Reports and reviews must not contain defamatory statements, personal attacks, or confidential information belonging to a third party • The HSE Hub reserves the right to edit, decline to publish, or remove any User Content that is inaccurate, harmful, misleading, unlawful, or otherwise violates these Terms, without notice

Certain features on The HSE Hub use artificial intelligence, including the Safety Chat assistant, the Gear Advisor, Safety Reminders, Toolbox Talk translation and drafting, job import parsing, and automated news and project summaries. • AI-generated output may contain errors, omissions, or outdated information and is provided for general informational purposes only • Field Safety Insights and other blog articles, whether written or AI-assisted, are general educational content and do not constitute professional HSE, legal, medical, or engineering advice • AI output does not constitute professional HSE, legal, medical, or engineering advice and must not be relied upon as the sole basis for any safety-critical decision • Users must verify AI-generated content against applicable regulations, manufacturer instructions, site-specific procedures, and the guidance of a qualified HSE professional before acting on it • Features that use AI are labeled as such within the platform • The HSE Hub LLC is not liable for any loss, injury, or damage arising from reliance on AI-generated content

Users may not use The HSE Hub platform to: • Post false, misleading, or fraudulent information, including fabricated Boneyard Reports, reviews, credentials, or accreditations • Scrape, harvest, or systematically extract candidate, employer, or Provider data • Contact candidates outside the platform without obtaining contact information through the proper Confidence Report or job application process • Share, resell, or redistribute purchased Toolbox Talk materials outside your own organization • Circumvent payment, verification, or access controls • Attempt to reverse-engineer, hack, or disrupt the platform • Violate any applicable federal, state, or local law or regulation • Harass, threaten, or abuse other users Violation of these terms may result in immediate account suspension and legal action.

The HSE Hub reserves the right, at its sole discretion, to: • Remove any user profile, job posting, Boneyard Report, review, Provider listing, or other content that violates these Terms of Service or our community standards • Suspend or permanently terminate any user account for any violation of these terms, fraudulent activity, or conduct detrimental to the platform or its users • Take action in response to complaints from other users, regulatory requirements, or legal obligations Termination of a paid subscription for cause does not entitle the user to a refund. Users who believe their account was terminated in error may appeal by contacting admin@thehsehub.com.

The HSE Hub platform, including its design, software, Toolbox Talk library, assessment content, trademarks, and branding, is the property of The HSE Hub LLC. Toolbox Talk purchases grant a limited license as described in Section 6 and do not transfer ownership. Users retain ownership of content they submit and grant The HSE Hub the license described in Section 7. Third-party trademarks appearing in Provider listings or Boneyard Reports belong to their respective owners.

In the event of a merger, acquisition, reorganization, or sale of all or part of The HSE Hub LLC's business or assets, these Terms of Service, your account, and your associated personal data may be transferred to the acquiring party as part of that transaction. Any such party will be bound by these Terms and by the commitments made in our Privacy Policy. We will notify registered users by email before any such transfer takes effect.

The HSE Hub platform is provided on an "as-is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components, nor do we warrant the accuracy of any Provider listing, Boneyard Report, news item, project intelligence, or AI-generated content.

To the maximum extent permitted by applicable law, The HSE Hub LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the platform, any hiring decision made based on our services, any transaction with a Provider, reliance on any Boneyard Report or AI-generated content, or workplace incidents involving candidates found through our platform. Our total liability for any claim shall not exceed the amount paid by the user to The HSE Hub in the 12 months preceding the claim.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms of Service or the use of The HSE Hub platform shall be resolved by binding arbitration administered in Sacramento, California, in accordance with the American Arbitration Association's Commercial Arbitration Rules. Each party shall bear its own costs. The arbitrator's decision shall be final and binding. This arbitration clause does not prevent either party from seeking injunctive relief in a court of competent jurisdiction.

We may update these Terms of Service at any time. Material changes will be communicated via email to registered users at least 14 days before taking effect. Continued use of the platform after the effective date constitutes your acceptance of the revised terms.

Incident investigation, safety audit, and virtual safety management engagements are professional advisory services. The specific deliverables, timing, assumptions, customer responsibilities, and exclusions are governed by the service description and any written intake, proposal, or statement of work for the engagement. Customers remain responsible for site operations, legal and regulatory compliance, implementation decisions, and the actions of their personnel and contractors. Consulting purchases are fully non-refundable. No recommendation guarantees a particular regulatory, safety, operational, or financial outcome.

Referral links are provided solely to help grow The HSE Hub community and attribute how new users discovered the platform. Participation does not create any right to a reward, payment, account credit, commission, or other benefit. The HSE Hub does not offer or guarantee referral compensation.

Career Services (Resume Rebuild, Interview Prep Session, Job Ready Package, and Resume Update) are preparation and coaching services intended to help candidates present their experience, certifications, and safety record more effectively. • The HSE Hub does not guarantee job placement, interviews, offers, salary outcomes, or any other employment result. No statement made in connection with these services constitutes such a guarantee • Deliverables are limited to the service description shown on the Career Services page. Resume Rebuild is delivered by email within 5 business days and Resume Update within 3 business days from the date all required information is received from the customer • Customers are responsible for the accuracy and truthfulness of all information they provide. We do not verify, embellish, or fabricate credentials, certifications, employment history, or safety records • Interview Prep Sessions are scheduled by mutual agreement. Missed sessions may be rescheduled once as a courtesy • Career Services purchases are non-refundable once work has begun. Free contact information updates for existing resume customers are provided as a courtesy and may be discontinued at any time • The free monthly newsletter may be cancelled by the subscriber at any time using the unsubscribe link in any issue
